Welcome to Trade Harbor ("Platform," "Service," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Trade Harbor website, application, and all related services. By creating an account or using the Platform in any way, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the Platform. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.
1. Definitions
"Content" means all text, data, analyses, recommendations, charts, scores, signals, AI-generated reasoning, and other information provided through the Platform.
"User" means any individual who accesses or uses the Platform, whether through a registered account or otherwise.
"Recommendation" means any trade idea, signal, heat score, AI analysis, or suggested action generated by the Platform's algorithms and AI models.
2. Nature of the Service
2.1 Research and Educational Purpose Only
Trade Harbor is a research and educational tool. All Content, including Recommendations, is provided strictly for informational and educational purposes. Nothing on this Platform constitutes, or is intended to constitute, investment advice, financial advice, trading advice, tax advice, legal advice, or any other form of professional advice.
2.2 No Fiduciary Relationship
Use of Trade Harbor does not create a fiduciary, advisory, broker-dealer, or client relationship between you and Trade Harbor. We are not a registered investment adviser, broker-dealer, financial analyst, or financial planner under the laws of any jurisdiction.
2.3 Not a Solicitation
No Content on this Platform constitutes a solicitation, recommendation, endorsement, or offer by Trade Harbor to buy or sell any securities, options, futures, or other financial instruments. Any references to specific securities or strategies are for illustrative and research purposes only.
2.4 AI-Generated Content
Recommendations and analyses on this Platform are generated by artificial intelligence models. AI-generated content may contain errors, inaccuracies, or outdated information. AI outputs should never be the sole basis for any financial decision. You must conduct your own independent research and due diligence before making any investment or trading decision.
2.5 TradeHarbor Assistant
The Platform includes an in-app AI assistant (the "TradeHarbor Assistant") that can answer questions about trading concepts, the Platform itself, and your own data (portfolio, recommendations, journal entries, and ML predictions). The assistant is designed as an analysis and explanation tool. It will not generate new trade recommendations in chat; any request for a new trade idea is redirected to the dedicated scan interface. You acknowledge that the assistant's responses are still AI-generated and subject to the same limitations described in Section 2.4 — they may contain errors, reference stale data, or misinterpret your inputs, and must not be the sole basis for any financial decision. Our Privacy Policy describes the specific data flows involved when you use the assistant, including the third-party AI providers that receive your data during an assistant turn.
3. Eligibility and Account Registration
3.1 Age Requirement
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform. By using Trade Harbor, you represent and warrant that you meet this requirement.
3.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
3.3 Accurate Information
You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate and complete.
4. User Responsibilities and Acknowledgments
4.1 Independent Decision-Making
You acknowledge and agree that all investment and trading decisions are your sole responsibility. You should consult with a qualified financial advisor before making any investment decisions. Trade Harbor does not and cannot take into account your personal financial situation, investment objectives, risk tolerance, or specific needs.
4.2 Risk Acknowledgment
You acknowledge that trading securities and options involves substantial risk of loss and is not suitable for every investor. Options trading, in particular, carries significant risk including the potential loss of the entire investment. Past performance of any strategy, analysis, or recommendation is not indicative of future results.
4.3 No Guarantee of Accuracy
While we strive to provide accurate and timely information, we do not guarantee the accuracy, completeness, reliability, or timeliness of any Content. Market data may be delayed by 15 minutes or more. Financial data is sourced from third-party providers and may contain errors.
4.4 Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to reverse engineer, decompile, or disassemble any part of the Platform
- Scrape, crawl, or use automated tools to extract data from the Platform
- Redistribute, resell, or commercially exploit Platform Content without authorization
- Interfere with or disrupt the Platform's infrastructure or other users' access
- Create multiple accounts or impersonate another person or entity
- Use the Platform to manipulate or attempt to manipulate any financial market
5. Intellectual Property
5.1 Our Rights
The Platform, including its source code, algorithms, design, text, graphics, logos, and all Content generated by our systems, is the exclusive property of Trade Harbor and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted herein are reserved.
5.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial research purposes, subject to these Terms.
6. Third-Party Data and Services
The Platform incorporates data from third-party sources including market data providers, financial data APIs, and AI services. We are not responsible for the accuracy or availability of third-party data. Your use of the Platform may be subject to the terms and conditions of these third-party providers.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
8. Disclaimers
8.1 "As Is" Basis
THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
8.2 No Warranty of Results
WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RECOMMENDATION OR ANALYSIS WILL RESULT IN PROFITABLE TRADES OR INVESTMENT OUTCOMES. WE MAKE NO WARRANTIES REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE PLATFORM.
8.3 Regulatory Disclaimer
Trade Harbor is not registered with, endorsed by, or affiliated with the U.S. Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), the Commodity Futures Trading Commission (CFTC), or any equivalent regulatory body in any jurisdiction.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRADE HARBOR, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, TRADING LOSSES, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use of, or inability to use, the Platform
- Any Recommendation, analysis, signal, or Content provided through the Platform
- Any trading or investment decisions made in reliance on the Platform
- Unauthorized access to or alteration of your data
- Errors, inaccuracies, or omissions in market data or Content
- Any third-party conduct or content on the Platform
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless Trade Harbor and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to your use of the Platform, your violation of these Terms, your trading or investment activities, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. Sections 2, 4, 5, 8, 9, 10, and 12 shall survive any termination.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
12.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may submit the dispute to binding arbitration under the rules of the American Arbitration Association, to be conducted in the State of Delaware.
12.3 Class Action Waiver
YOU AGREE THAT ANY CLAIMS RELATING TO THESE TERMS OR THE PLATFORM WILL BE BROUGHT ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
13. International Users
If you access the Platform from outside the United States, you do so at your own initiative and are responsible for compliance with local laws. The Platform may not be appropriate or available for use in all jurisdictions. Content and Recommendations are generated based on U.S. market data and may not be suitable for investors in other jurisdictions.
14. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Platform.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, and Investment Disclaimer, constitute the entire agreement between you and Trade Harbor regarding your use of the Platform and supersede all prior agreements, understandings, and communications.
